Terms and Conditions

These Terms and Conditions govern all use of the Elevated Strategies Pty Ltd (“Elevated Strategies”, “we”, “our”, “us”) website and apply to all services supplied by Elevated Strategies. By accessing our website or engaging our services, the Client or website user (“you”, “your”, “Client”) agrees to be bound by these Terms in full. These Terms operate alongside any Proposal, Engagement Letter or Statement of Work (“SOW”) issued by Elevated Strategies, and where there is any inconsistency, the terms of the Proposal or SOW prevail.

1. Use of Website

This website provides information about our consulting, management, project, and advisory services. Website content is provided for general information only and does not constitute professional advice. All content is owned or licensed by Elevated Strategies. You may view and share material for legitimate business purposes, but you must not copy, reproduce, distribute, modify, upload or publish any content without our written permission. We do not guarantee that the information on this website is current, complete or error-free, and we may update or change it at any time. Website information may be changed or removed at any time. The website may use cookies and analytics technologies, and by using the website, users consent to such use. Personal information collected through the website is handled in accordance with the Elevated Strategies Privacy Policy.

2. Scope of Services

  

Elevated Strategies provides consulting, advisory, interim management, project management, marketing support and leadership development services. The specific scope and deliverables of each engagement will be defined in a Proposal or SOW that must be accepted by the Client before services commence. Elevated Strategies will perform services with reasonable care, skill and diligence of a professional consulting firm, but does not guarantee any specific commercial, operational, strategic or financial outcome.

3. Professional Fees and Pricing

Fees for the services are charged in accordance with the rates specified in the applicable Proposal or SOW. All fees are exclusive of GST unless stated otherwise. Invoices are issued periodically and are payable within seven days of the invoice date. Elevated Strategies may suspend services where invoices remain unpaid after the due date. Estimates provided to the Client are not binding unless expressly confirmed in writing.

All fees are quoted in Australian dollars and are exclusive of GST. Our standard rates are:

  • Senior Consultant / Interim Manager: AUD 250 per hour or AUD 2,000 per on-site day
  • Weekend or after-hours consulting: AUD 2,400 per on-site day 
  • Travel time: AUD 250 per hour 
  • Marketing & Project Specialist: AUD 150 per hour or AUD 1,200 per on-site day

4. Estimates and Variations

Any estimate supplied by Elevated Strategies is indicative and not a fixed quote, unless expressly confirmed in writing. Actual costs may vary due to changes in scope, urgency, complexity, travel requirements, delays in receiving information, or other factors beyond our control. Where appropriate, revised estimates will be provided. 

5. Travel, Accommodation and Allowances

The Client must reimburse Elevated Strategies for reasonable out-of-pocket expenses incurred in performing the services, including travel, accommodation and related costs, unless otherwise agreed in writing. Where services require access to the Client’s site or systems, the Client must ensure compliance with relevant workplace health and safety laws and provide a safe working environment.

6. Minimum Engagement Term and Termination

Unless otherwise agreed, consulting and interim management engagements require a minimum term of six months and continue on a monthly basis thereafter. Either party may terminate an engagement with 30 days’ written notice. Upon termination, the Client must pay for all services delivered up to the termination date, as well as any travel costs already incurred or contractually committed. Elevated Strategies may suspend or terminate services immediately in the event of non-payment or material breach. 

7. Client Responsibilities

Clients must ensure that Elevated Strategies receives all information, access, approvals and cooperation reasonably required to deliver the agreed services. Clients are responsible for the accuracy and completeness of all information provided and for ensuring that any facility or site we attend complies with applicable Work Health & Safety (WHS) legislation. We may decline or stop work if a site is unsafe or if information essential to service delivery is withheld or delayed. The Client indemnifies Elevated Strategies for any loss, liability, cost or expense arising from inaccurate or delayed information provided by the Client, breaches of these Terms, unsafe worksites, delays caused by the Client, or reliance by Elevated Strategies on information provided by the Client. This indemnity survives termination. All reports, recommendations, deliverables and documents supplied by Elevated Strategies are prepared solely for the Client’s internal use and for the specific purpose for which the services were engaged. They must not be disclosed to or relied upon by any third party without Elevated Strategies’ written consent.

8. Confidentiality

Each party must treat all non-public information belonging to the other as confidential and must not disclose such information except where required by law or with the express written consent of the disclosing party. Confidentiality obligations continue indefinitely after termination. Neither party may disclose confidential information to any third party except in accordance with these Terms. Both parties must take reasonable steps to prevent unauthoriseddisclosure or misuse.

9. Intellectual Property

Elevated Strategies retains ownership of all methodologies, templates, systems, frameworks, tools and intellectual property developed independently or prior to the engagement. Intellectual property created specifically for the Client becomes their property only when all fees and expenses have been paid in full. Elevated Strategies may continue to use non-client-specific knowledge, experience and concepts gained during the engagement.

10. Subcontracting

Elevated Strategies may engage employees, contractors or subcontractors to assist in delivering services. Elevated Strategies remains responsible for its conduct and compliance with confidentiality obligations. Elevated Strategies maintains Public Liability insurance of AUD 20,000,000 and Professional Indemnity insurance of AUD 1,000,000.

11. Work Health & Safety (WHS)

Clients must provide a safe work environment at any site we are required to visit. We reserve the right to refuse entry to, or leave, any environment deemed unsafe or non-compliant.

12. Force Majeure

Elevated Strategies is not responsible for failure or delay in the performance of obligations where such failure results from events beyond its reasonable control, including natural disasters, pandemics, industrial disputes, civil unrest, cyber incidents and government restrictions.

13. Cyber Security

Bank account details will never be changed or updated via email alone. Clients must verify payment details by telephone prior to transferring funds. Elevated Strategies accepts no responsibility for losses caused by cyber-fraud or misdirected payments arising from unauthorised interference.

14. Insurance and Limitation of Liability

Elevated Strategies maintains Public Liability insurance of AUD 20,000,000 and Professional Indemnity insurance of AUD 1,000,000. To the fullest extent permitted by law, the total liability of Elevated Strategies to the Client, whether arising in contract, tort, statute or otherwise, is limited to the total professional fees paid by the Client to Elevated Strategies in the twelve months preceding the event giving rise to the claim. Elevated Strategies is not liable for any consequential, indirect or special loss, including loss of profit, revenue, opportunity, business interruption or reputational damage. Elevated Strategies is not liable for any penalties, liquidated damages, delay charges, service credits or similar financial sanctions unless expressly accepted in writing by an authorisedofficer of Elevated Strategies.

15. Termination

Either party may terminate an engagement by giving thirty days’ written notice unless otherwise stated. Elevated Strategies may terminate immediately for non-payment or material breach. Upon termination, the Client must pay all fees for services provided up to the termination date and all expenses incurred or committed.

16. Dispute Resolution

Before commencing any legal proceedings, the parties must attempt to resolve disputes through good-faith discussions. If unresolved after 14 days, the matter must be referred to mediation in Western Australia. Only if mediation fails may legal action proceed. Nothing prevents a party from seeking urgent injunctive relief.

17. Governing Law

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia, and the parties submit to the jurisdiction of the courts of Western Australia. If a dispute arises, the parties must attempt to resolve it through good-faith discussions and mediation before commencing litigation, except where urgent injunctive relief is required.

18. Cookies and Tracking Technologies

This website uses cookies and similar technologies to enhance user experience, analyse traffic and support performance and marketing functions. By using the website, you consent to the use of cookies. You may disable cookies in your browser, though certain features may not operate as intended. We use essential cookies for site functionality, analytics cookies for performance measurement, and, where relevant, marketing cookies for advertising insights. No personal data is sold to third parties.

19. Changes to These Terms

Elevated Strategies may amend these Terms at any time by publishing an updated version on its website. Any modifications apply to all services provided after publication. These Terms, together with the Proposal or SOW, constitute the entire agreement between the parties and supersede all prior oral or written communications. No variation is effective unless in writing and formally approved by an authorisedrepresentative of Elevated Strategies.
